Terms of Service

These Terms of Service ("Terms") govern your use of products and services provided by VIKRR ("we," "us," or "our"), including TAKT and VIKRR Asset Shield. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any VIKRR product, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our services.

2. Description of Services

• TAKT is a personal nutrition intelligence platform that provides AI-powered food recognition, nutritional tracking, hydration monitoring, supplement management, body metrics tracking, and integration with third-party health services (Garmin Connect, Google Fit, Zepp Life).
• VIKRR Asset Shield is a maintenance management system providing asset tracking, work order management, and inspection compliance tools.

3. Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use our services
• One person may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

• Use the services for any unlawful purpose
• Attempt to gain unauthorized access to any part of the services
• Interfere with or disrupt the integrity of the services
• Upload malicious content, viruses, or harmful code
• Scrape, crawl, or use automated means to access the services without permission
• Reverse engineer or attempt to extract the source code of our software
• Resell or redistribute the services without written permission

5. Health Disclaimer

TAKT is not a medical device and does not provide medical advice.

• Nutritional information provided by TAKT (including AI-powered estimates) is for informational purposes only and should not be relied upon as medical or dietary advice
• AI-generated nutritional estimates may contain inaccuracies. Always verify critical nutritional information independently
• Body metrics, health trends, and AI-generated insights are estimates and should not replace professional medical consultation
• If you have specific dietary requirements, food allergies, or health conditions, consult a qualified healthcare professional before making dietary changes based on TAKT data
• VIKRR is not liable for any health consequences arising from dietary decisions made based on information provided by our services

6. Third-Party Integrations

Our services may integrate with third-party platforms including Garmin Connect, Google Fit, Zepp Life, OpenFoodFacts, and Google Gemini AI. These integrations are subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services.

• You authorize data transfer between VIKRR and connected third-party services when you enable an integration
• You can disconnect any integration at any time from the application settings
• Third-party service outages may temporarily affect VIKRR functionality

7. Intellectual Property

• All VIKRR products, designs, logos, and content are the property of VIKRR s.r.o.
• You retain ownership of all data you input into our services
• By using our AI features, you grant us a limited license to process your food photos and descriptions for the purpose of providing nutritional analysis
• We do not claim ownership of your personal data or user-generated content

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects service availability
• We reserve the right to modify, suspend, or discontinue any part of the services with reasonable notice
• Free-tier features may be modified or limited at our discretion

9. Account Termination

• You may delete your account at any time by contacting info@vikrr.com
• We may suspend or terminate your account if you violate these Terms
• Upon account termination, your personal data will be deleted within 30 days in accordance with our Privacy Policy
• We may retain anonymized, aggregated data that cannot be linked back to you

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• VIKRR services are provided "as is" and "as available" without warranties of any kind, either express or implied
• We do not warrant that the services will be error-free, secure, or uninterrupted
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services
• Our total liability for any claim related to the services shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater
• Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence)

11. Indemnification

You agree to indemnify and hold harmless VIKRR, its officers, directors, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the services.

12. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes arising from these Terms shall be resolved by the competent courts in the Czech Republic. For EU consumers, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
